These Terms govern the use of the Totalmobi GolfScore service (the “Service”), provided by Sergio Ayroza Cury (“Totalmobi”), tax number 294804781, established at Rua dos Pinheiros 80 RC D, Cascais, Portugal, contact contato@totalmobi.pt. By creating an account or subscribing to a plan, the customer accepts these Terms and the Privacy Policy.
The Service is a web platform for clubs, associations and federations to manage golf tournaments (course and player registration, entries, handicap, draws, score entry, standings, prizes and public scoreboard), also working offline.
The customer is responsible for the accuracy of registration data, for keeping the password secure, and for all activity on their account. They must notify Totalmobi of any unauthorised use.
The prices shown at the time of subscription are those that apply. Taxes (VAT and others) are added where due. Totalmobi may change prices with reasonable notice; changes do not affect the period already paid.
Payments are processed by Stripe. Subscriptions renew automatically at the end of each period (monthly or annual), charged to the registered payment method, until cancelled.
The customer may cancel at any time; cancellation takes effect at the end of the period already paid, with access maintained until then. Except for any applicable right of withdrawal (section 6), periods already started are not refunded.
If the customer is a consumer (a natural person acting outside their trade or profession) in the EU, they have the right to withdraw from the contract within 14 days without justification. When subscribing to a digital service with immediate performance, the customer may be asked to consent to immediate start and acknowledge that they lose that right once the service is performed. As customers are typically clubs/businesses (B2B), this right may not apply.
The customer agrees not to: use the Service for unlawful purposes; enter data without a legal basis; attempt to access other clubs' data; overload, copy or reverse-engineer the platform. Breach may lead to suspension or termination of the account.
The platform, software and the Totalmobi GolfScore brand are owned by Totalmobi. The customer retains ownership of their data (club, players, tournaments) and may export or request it while the account is active. Totalmobi does not claim ownership of that data.
Totalmobi strives to keep the Service available but does not guarantee uninterrupted operation. Interruptions may occur due to maintenance, updates or external causes (network, processors). Offline mode allows entry to continue during network outages.
To the maximum extent permitted by law, Totalmobi is not liable for indirect damages, lost profits or data loss arising from use of the Service. Total liability, in any case, is limited to the amount paid by the customer in the 12 months before the event. Nothing in these Terms excludes liability that the law does not allow to be excluded.
Totalmobi may suspend or terminate accounts that breach these Terms or fail to pay. After termination, data is handled according to the Privacy Policy.
The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms. For player data, Totalmobi acts as the club's processor.
WhatsApp support is provided by an automated assistant powered by artificial intelligence, which identifies itself as such. The information it provides is indicative only and does not bind Totalmobi: only terms confirmed in writing by a person, or set out in these Terms and the current price list, constitute an offer. The customer may ask to speak to a person at any time. Processing of the data from that support is described in the Privacy Policy.
Totalmobi may update these Terms, communicating material changes by e-mail or in the application. Continued use after they take effect implies acceptance.
These Terms are governed by Portuguese law. For disputes with consumers, the mandatory rights of the consumer's country of residence remain, as does recourse to alternative dispute resolution. Competent courts: those of Portugal.
